Welcome to Controversial T-shirts (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://www.controversialtshirts.com and your purchase of products from us (the “Services”).
By accessing the site or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we sell to (United States & Canada only)
We currently accept orders for shipment to addresses in the United States and Canada only. We do not ship to other countries at this time. If you place an order with a shipping address outside the United States or Canada, we may cancel it and refund you.
You must be the age of majority in your place of residence (or have parental/guardian consent where allowed) to purchase from us.
2. Products & print-on-demand
Most products are made to order through our print-on-demand fulfillment partners after you place an order. Colors, garment brands, and print placement can vary slightly from on-screen mockups due to screen settings, fabric differences, and production tolerances. Product photos and mockups are illustrative.
3. Content, speech merch & disclaimers
Our products include expressive, satirical, political, and otherwise controversial messaging (“speech merch”).
• Opinions expressed on products are statements of opinion, parody, satire, or commentary — not statements of fact about any person or group unless clearly presented as such.
• Product designs do not reflect an endorsement by any public figure, brand, political party, or organization unless we expressly say so.
• Viewing or purchasing a design does not mean we endorse every interpretation of that design.
• You agree you are choosing to buy expressive merchandise and that some designs may offend you or others.
Our Content Disclaimer page is incorporated into these Terms by reference. If you find content you believe is unlawful, email contact@controversialtshirts.com with a detailed report. We may remove or refuse designs at our discretion, including to comply with Shopify, our fulfillment partners, payment processors, or advertising platform rules.
4. Orders, pricing & payment
• Prices are shown at checkout and may change without notice before you order.
• Applicable taxes and shipping fees are calculated at checkout.
• Payment is processed through Shopify and its payment partners.
• We reserve the right to refuse or cancel any order (including suspected fraud, address issues, IP/policy conflicts, or fulfillment limits). If we cancel after charge, we will refund you.
5. Shipping
Shipping is handled under our Shipping Policy. Title and risk of loss pass to you when the carrier delivers the package to the address you provided (or when the carrier first attempts delivery, if you refuse or fail to accept delivery).
6. Returns & refunds
Returns and refunds are governed by our Refund Policy. Because items are typically custom-printed, many sales are final except for defects, wrong items, or other cases listed there.
7. Intellectual property
Store content, brand names, logos, product designs we create, and related materials are owned by us or our licensors. You may not copy, scrape, redistribute, or commercially exploit our designs or site content without permission.
You may not upload, request, or use the Services to infringe others’ trademarks, copyrights, publicity rights, or other rights. We may cancel orders or remove listings that appear to infringe third-party rights.
8. Acceptable use
You agree not to:
• Use the Services for unlawful purposes
• Attempt to disrupt or hack the site
• Scrape the site in abuse of our systems
• Harass our team or other customers
• Place fraudulent orders
9. User reviews & submissions
If you submit reviews, comments, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content in connection with the Services. Do not submit unlawful, infringing, or abusive content.
10. Third-party services
The Services rely on third parties (Shopify, fulfillment partners, carriers, payment processors, analytics/ads). Their terms and privacy policies also apply to their processing. We are not responsible for third-party outages beyond our reasonable control.
11. Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED.
Some jurisdictions (including parts of Canada) do not allow certain disclaimer limitations; in those places, our disclaimers apply only to the maximum extent allowed.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.
These limits do not apply to liability that cannot be limited under applicable law (including certain consumer protections in Canada).
13. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services, your violation of these Terms, or your infringement of someone else’s rights — except to the extent caused by our own willful misconduct.
14. Governing law & disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, except that Canadian consumers may retain mandatory protections of the province/territory where they reside.
If you are a U.S. customer: disputes will be resolved in the state or federal courts located in Florida, unless applicable law requires otherwise.
If you are a Canadian consumer: nothing in these Terms waives rights you cannot waive under applicable Canadian consumer protection law.
15. Changes
We may update these Terms by posting a new version on this page. Continued use after changes means you accept the updated Terms, except where notice or consent is required by law.
